Evidence At Trial
If section 17.1(7) applies to you, then thee pieces of evidence must be presented at trial:
- evidence of the ownership of the vehicle;
- the certificate of parking infraction ; and
- a copy of the notice of trial.
Wait until the Crown has rested, that is the prosecutor has no further evidence to present. If he/she hasn't presented all of the evidence, make a motion of non-suit.
Typically the certificate and evidence of the ownership are filed with the court in advance when requesting a trial date. But the prosecutor may not have or may forget to submit the notice of trial as evidence. You can then argue that they did not provide the minimum evidence to convict you. Quote section 17.1(7) or 18.1.1(2.1) of the POA.
